Tweed Early Warning

By subscribing to the Tweed Early Warning (Service), you acknowledge and agree to the following:

  1. The Service is provided by Tweed Shire Council (Council), as part of a collaborative project between Council, NSW State Emergency Services and Bureau of Meteorology (together the Project Group).
  2. The Service intends to provide to you, via alert message sent through Tweed Early Warning, early warning of potential flash flooding to specific locations based on publicly available information.
  3. While Council will use reasonable endeavours to ensure that the Service is provided to you at the earliest opportunity, the System relies on telecommunication networks to send alerts and the delivery of message cannot be guaranteed.
  4. As the Service is subject to naturally occurring events, the Project Group does not warrant the accuracy and completeness of the information. The Service should not be solely relied upon. You are responsible for verifying the information provided through the Service and making your own independent assessment of the risks.
  5. Council is collecting your personal information in order to enable Council to provide the Service. The intended recipient of the information is Tweed Shire Council. While the supply of this information is voluntary, the personal information you provide will enable Council to provide the Service to you. The personal information can be accessed by you and may also be available to third parties in accordance with Tweed Shire Council's Privacy Management Plan. You may make an application for access or amendment to personal information held by Council. Council will consider any such application in accordance with the Privacy and Personal Information Protection Act 1998. Council is the agency that holds the personal information. Council may be contacted on 02 6670 2400 or at one of our administration offices at 10–14 Tumbulgum Road, Murwillumbah NSW 2484 or at the corner of Brett and Wharf streets, Tweed Heads NSW 2485.
  6. You are responsible for updating your registered contact details if and when they change.
  7. You may be contacted by Council for the purpose of evaluating the Service provided.
  8. You acknowledge that you are using the Service and System at your own risk. In consideration of you using the Service and the System, you acknowledge and agree that the Project Group (including the respective directors, officers, employees and agents of each party in the Project Group) are not responsible (either jointly or severally) for any loss or damage suffered, incurred or sustained by you, in whatever nature and howsoever arising, in connection with the Service or System and to the extent permitted by law, you release each party in the Project Group in this respect (Release). This Release includes, but is not limited to, any loss or damage suffered, incurred or sustained by you arising from:
    • the delay and failure in warning you of an event
    • the interpretation of the magnitude or severity of an event
    • provision of an alert that warns of an event that fails to materialise
    • any inaccuracies in the predictions of the location of an event
    • the delay and failure in warning you of an event
  9. You expressly agree that the Release does not affect or limit s733(1) of the Local Government Act 1993 or the provisions of Part 5 of the Civil Liability Act 2002.
  10. As permitted by law, Council excludes all conditions and warranties relating to your use of the Service that are not expressly outlined in these conditions.
